The impending missions to exploit natural resources of celestial bodies may at some point start interfering with the scientific interests, including those of astrobiology, in these bodies. While the legal status of celestial bodies at the highest level is clear, uncertainty has arisen as to the extent private property rights over such objects or over their resources are legally acceptable, legally impossible, or potentially legal. This also provides for a considerable amount of uncertainty regarding how the legal framework could or (...) may need to be changed to accommodate private interests. The article analyzes the two main international treaties relevant from this perspective, as well as their backgrounds, in order to outline the current legal status of celestial bodies and the resulting legal rights and obligations pertinent to both private exploitation and exploration. Based on such an analysis, it concludes by highlighting an approach that could actually incentivize the private sector and the science community to work together in a manner conducive to their interests in exploitation and exploration respectively. Welches Recht ist gerecht? So lautet die Grundfrage der Rechtsethik. Die Rechtsethik fragt also nach der Rechtfertigung und Kritik des Rechts. Dabei geht es ihr nicht nur wie der dogmatischen Rechtsanwendung um die Analyse der Normen und Wertungen des geltenden Rechts, sondern um einen ethischen Maßstab des Rechts.

Kenley Dove’s article [OWL, IX-4] seems to overlook that certain thinker who could probably be the key to the proper elucidation of Hegel’s thought on creativity, i.e. Plotinus. Dove’s threefold breakdown of classical Greek and medieval Christian ideas of creation is cogent, though he fails to include the Neo-Platonic bridge which could not only harmonize for him the “deterministic” metaphysics of the Greeks with the ex nihilo “free-act-of-God” metaphysics of Aquinas, but also provide him with a way to understand that (...) In recent years, the public sector in many countries has had difficulty keeping abreast of social problems due to restricted financial resources and limited organizational capacities. As a consequence, entrepreneurs have started to address social welfare issues that the public sector has been unable to tackle with an innovative approach called social enterprise. The authors present research on the future prospects of social enterprise as a sustainable business model for industrialized countries. As there is a lack of historical and current (...) data, the authors aim to contribute to and structure the debate about the potential of the concept. Therefore, the authors provide initial data from a Delphi survey on the future development of social enterprise in a multistakeholder environment. Experts from academia, business, nongovernmental and governmental organizations, social enterprise investors, and social entrepreneurs evaluated 16 projections for the year 2030. Based on these results, the authors present comprehensive scenarios of four different possible developments of the future of social enterprise in Germany. (shrink)

Der Beitrag entfaltet eine normative Ethik mit folgenden fünf Elementen: den normativen Individualismus als Ausgangspunkt, die Berücksichtigung der Ziele, Wünsche, Bedürfnisse und Strebungen aller betroffenen Individuen als rechtfertigende Eigenschaften, einen Pluralismus des Bezugs dieser Belange auf alle möglichen Elemente unseres Handelns, die Notwendigkeit eines Zusammenfassungsprinzips dieser Belange, schließlich als Zusammenfassungsprinzip das sog. Prinzip der relativen Individual- und Anderer- bzw. Gemeinschaftsbezogenheit.

The article aims to clarify Kant's concept of law, which he developed in the “Metaphysische Anfangsgründe der Rechtslehre” from 1797. Decisive for Kant's concept of law is the distinction between internal and external relations of persons. Law is restricted to external relations. So the crucial question is: Where does Kant draw the line between internal and external relations? Four possibilities are analysed in an order of increasing extent: only causal consequences of our actions in the external world beyond our bodies; (...) causal consequences in the external world plus our externally empirical sensible bodily behaviour; causal consequences in the external world plus all physiological changes in the actor like nerve stimulations and brain activities; all features of plus all non-a-priori mental and emotional changes like emotions, inclinations, empirical concepts, hypothetical imperatives etc., in sum: Kant's division between homo noumenon and homo phaenomenon. While modern interpretations would perhaps endorse possibility, Kant has chosen – so the main argument of the article – the widest possible alternative. This brings him to a very extensive concept of law. Only in reflecting this wide extent of Kant's concept of law, we are able to understand his philosophy of law. (shrink)

ABSTRACTThe ability to evaluate scientific claims and evidence is an important aspect of scientific literacy and requires various epistemic competences. Readers spontaneously validate presented information against their knowledge and beliefs but differ in their ability to strategically evaluate the soundness of informal arguments. The present research investigated how students of psychology, compared to scientists working in psychology, evaluate informal arguments. Using a think-aloud procedure, we identified the specific strategies students and scientists apply when judging the plausibility of arguments and classifying (...) common argumentation fallacies. Results indicate that students, compared to scientists, have difficulties forming these judgements and base them on intuition and opinion rather than the internal consistency of arguments. The article aims to understand the phenomenon of law/the concept of law from a philosophical perspective. First, it is argued that law is a sort of human action. Therefore, the phenomenon of law can only be understood by analyzing the two main elements of human actions: aims and means. The aim of law is the mediation between possible contrary, conflicting concerns. The four parts of this aim are analyzed. But also morals and other social norms have a similar aim. So (...) law has to be distinguished from morals and these other social norms by its specific means. The specific means of law are its categorical character, its externality, its formality and - if law and religion are separated like in many modern societies - its immanence. (shrink)

Die Frage nach der Gerechtigkeit wurde in der Antike vor allem als Frage nach dem tugendhaften Leben und Handeln verstanden. In der Gegenwart wird dagegen stärker die politische und soziale Gerechtigkeit thematisiert. Diese einzelnen historischen Akzentuierungen dürfen jedoch nicht über den grundsätzlichen Charakter der Gerechtigkeit als Teil der allgemeinen Ethik hinwegtäuschen.

In his 1985 book on philosophy and atheism, the Canadian thinker Kai Nielsen, a prolific writer on the subject, wonders why the philosophy of religion is ‘so boring’, and concludes that it must be ‘because the case for atheism is so strong that it is difficult to work up much enthusiasm for the topic.’ Indeed, Nielsen even regards most of the contemporary arguments for atheism as little more than ‘mopping up operations after the Enlightenment’ which, on the whole, add little (...) to the socio-anthropological and socio-psychological accounts of religion provided by thinkers like Feuerbach, Marx and Freud, as any ‘reasonable person informed by modernity’ will readily acknowledge. On this view, the answer to Kant's question – ‘What may we hope?’ – does not gesture towards a resurrection and personal immortality, but instead to the death of religious discourse itself: I think, and indeed hope, that God-talk, and religious discourse more generally, is, or at least should be, dying out in the West, or more generally in a world that has felt the force of a Weberian disenchantment of the world. This sense that religious convictions are no longer a live option is something which people who think of themselves as either modernists or post-modernists very often tend to have. (shrink)

Strategische Kommunikation zielt mit ihren kontingenten Wirklichkeitsbeschreibungen seit jeher auf gesellschaftliche Wahrheitsmodelle. Wie häufig gesellschaftliche Wahrheitsmodelle auf strategische Kommunikationsbemühungen zurückgehen, auf Unwahrhaftigkeit beruhen und damit zumindest zeitweise zu strategischen Wahrheiten werden, zeigen eindrucksvoll zwischenzeitlich geglaubte Wahrheiten, die sich als Lüge entpuppt haben: von Walter Ulbrichts "Niemand hat die Absicht, eine Mauer zu errichten" über Hitlers Tagebücher bis hin zu den Massenvernichtungswaffen im Irak. Die erfolgreichen Kampagnen der Brexiteers und von Donald Trump 2016 haben diesem Thema zu neuer und bislang ungeahnter (...) Aufmerksamkeit verholfen. Während die Themen Desinformation und postfaktische Gesellschaft die Journalismus-, politische Kommunikations- und Medienethikforschung aktuell zu dominieren scheinen, ist das Schweigen der deutschsprachigen und internationalen PR- und Organisationskommunikationsforschung auffällig. Dies ist umso bemerkenswerter, weil die PR-Wissenschaft in der Vergangenheit immer wieder versucht hat, ihren Gegenstand zu schärfen, indem sie sich am Begriff der Propaganda abgearbeitet hat. Daraus müsste eigentlich eine Affinität für das Thema Desinformation resultieren. Aber genau das Gegenteil ist offensichtlich der Fall: Hat sich die PR-Wissenschaft gerade deshalb nicht mit Desinformation beschäftigt, weil sie sich so dezidiert von Propaganda und darin eingeschlossenen desinformierenden und manipulativen Techniken abgrenzen will? Was sind die Gründe hierfür? Glauben wir, bereits alles zum Thema gesagt zu haben? Liegt dies daran, dass sich die PR- und Organisationskommunikationsforschung seit jeher vor allem für Unternehmen und weniger für politische und Non-Profit-Organisationen interessiert? Oder fühlen wir uns hier schlicht und ergreifend nicht zuständig? Es scheint offenkundig höchste Zeit zu sein, sich wieder eingehend mit Fragen der Desinformation aus der Perspektive der strategischen Kommunikationsforschung zu befassen. Die Beiträge des Tagungsbandes fokussieren hierzu auf neue theoretische Perspektiven, normative Bewertungen und empirische Befunde. (shrink)

The article tries to inquire a third way in normative ethics between consequentialism or utilitarianism and deontology or Kantianism. To find such a third way in normative ethics, one has to analyze the elements of these classical theories and to look if they are justified. In this article it is argued that an adequate normative ethics has to contain the following five elements: (1) normative individualism, i. e., the view that in the last instance moral norms and values can only (...) be justified by reference to the individuals concerned, as its basis; (2) consideration of the individuals' concerns and interests—aims, desires, needs, strivings—insofar as they have a justificatory function; (3) a pluralism of references of these concerns and hence of moral norms and values to all possible elements of actions; (4) the necessity of a principle of aggregation and weighing with regard to these concerns; (5) finally, as a central principle of aggregation and weighing, the principle of relative reference to self and others, operating as a generalizing meta-principle that guides the application of concrete principles and decisions. Simone Weil's influence has been enormous and in this age of doubt and uncertainty there is something particularly appealing about this French Jewish writer, for Weil lived out her beliefs. From an early age she was attracted to Bolshevism, became an anarchist and helped Trotsky. She joined the International Red Brigade to fight Franco in the Spanish Civil War. An agnostic, she experienced a profound religious conversion, yet never converted to the Christian faith to which she was so deeply attracted. (...) This clear lucid exposition of her life and work shows how Weil is truly a prophet for our age and an indispensable source of encouragement to all those at the frontiers of religion, both within and without. Robert R. Williams’ summary of my ideas about Hegel’s reading of the first edition of Schleiermacher’s Glaubenslehre is not wrong, but is a distortion on the side of oversimplification and overstatement. However, I must not condemn too harshly, since I am guilty of a certain measure of these same faults in my original presentation.

Eine Analyse der Politischen Philosophie der Neuzeit kann – soll sie nicht lediglich einzelne Autoren oder Werke reihen – zwei methodische Wege einschlagen. Sie kann zum einen mit einer detaillierten Werkinterpretation wichtiger Denker wie Hobbes, Locke oder Kant beginnen und quasiinduktiv den historischen Fortgang der Hauptdiskussionen zu rekonstruieren suchen. Sie kann aber auch wesentliche abstrakte Verlaufskategorien vorschlagen, mit deren Hilfe dann umgekehrt in einem quasideduktiven Konkretionsschritt die Beiträge eminenter Denker möglichst gut verstanden, eingeordnet und gewürdigt werden.Der vorliegende Text wird zum (...) Zweck der Beurteilung dieser beiden großen Alternativen zunächst einige Anforderungen vorschlagen, die derartige abstrakte begriffliche Kategorien erfüllen sollten, um zum Verständnis der Ideengeschichte der neuzeitlichen Politischen Philosophie beitragen zu können . In einem zweiten Schritt werden die beiden soeben genannten Gegensatzpaare an Hand dieser Anforderungen beurteilt . Diese Beurteilung wird zu dem Ergebnis führen, daß beide Gegensatzpaare zwar unabdingbar notwendig sind, um wesentliche Autoren der Politischen Philosophie der Neuzeit würdigen zu können. Für die Erfassung des Verlaufs der grundlegenden Auseinandersetzung in der neuzeitlichen Politischen Philosophie reichen sie aber nicht aus. Deshalb wird drittens das schon im Titel dieses Beitrags genannte Kategorienpaar „Normativer Individualismus versus normativer Kollektivismus" vorgeschlagen . Mit Hilfe dieses Gegensatzpaares und einiger Ergänzungen wird dann viertens die Grundlinie der Auseinandersetzung in der neuzeitlichen Politischen Philosophie skizziert werden . Diese Skizze soll schließlich zu einem besseren Verständnis der gegenwärtigen Diskussionslage führen. (shrink)
